The Fair Deal NY campaign is supported by labor, legal services, nonprofit organizations, consumer advocates, small business groups, and community-based organizations that want to end abusive and unfair business practices in New York. The campaign supported the Fostering Affordability and Integrity through Reasonable Business Practices Act (“FAIR Act” A.8427/Attorney General Program Bill #2), which was legislation championed by New York State Attorney General Letitia James and sponsored by Senator Leroy Comrie and Assemblymember Micah Lasher. However, the version of the FAIR Act recently passed by the Senate (S8416), which strengthens the Office of the Attorney General’s authority regarding unfair and abusive business practices, does not address the outdated legal standard applicable to private lawsuits under the existing consumer protection law. While this partial measure will offer some help to consumers, S8416 does not include the full protections that New York needs, and leaves our state lagging behind 42 other states.
